Murphy v. Missouri Dep't of Corr., 06-1603

In an inmate's action raising a 42 U.S.C. section 1983 First Amendment free speech claim, and a claim brought pursuant to the Religious Land Use and Institutionalized Persons Act (RLUIPA), a judgment and denial of plaintiff's motion for new trial after an adverse jury verdict on the claims is affirmed over claims that: 1) the trial court erred in instructing the jury as to both claims; 2) the denial of the new trial motion was error; 3) the trial court erred in excluding certain evidence; and 4) it also erroneously denied a motion for reconsideration.
