Brockinton v. City of Sherwood, 06-3293

In a suit brought against a city and several law-enforcement officers under 42 U.S.C. section 1983, alleging violations of his constitutional rights, summary judgment for defendants is affirmed where, while plaintiff alleged facts indicating that both a sheriff's department and a city police department made mistakes in judgment that caused him harm, section 1983 does not provide the appropriate remedy for his alleged injuries. However, plaintiff remains free to pursue his state-law claims, which were dismissed without prejudice.
