US v. Brown, 06-4014
A conviction and sentence for possession with intent to distribute cocaine base is affirmed where: 1) a suppression motion was properly denied as an affidavit provided a substantial basis for the issuing magistrate to conclude that probable cause existed, even without certain challenged information; 2) there was no error in allowing the government to produce evidence about defendant's prior drug sales; 3) arguments regarding findings of crack versus cocaine powder are rejected; and 4) there was no error in the district court's drug quantity calculations.
