Shuck v. CNH Am., LLC, 06-4180
In an action against a combine manufacturer arising from a fire in a combine's engine compartment that caused extensive damage to the combine and onboard corn, a judgment pursuant to a jury verdict finding the manufacturer liable under theories of breach of express warranty and strict liability is affirmed where: 1) there was no abuse of discretion in the admission of certain challenged expert testimony; 2) there was no error with regard to the scope of one expert's testimony; 3) the evidence, viewed in a light most favorable to the verdict, provided ample support for the jury's findings on the breach of express warranty claim; 4) the district court properly submitted the strict liability claim to the jury; 5) sufficient evidence supported the jury's verdict as to that claim; and 6) the district court properly denied defendant's motion for judgment as a matter of law.
