LaSalle v. Mercantile Bancorporation, Inc., 06-3783
In plaintiff's action arising from the termination of his disability benefits under ERISA, summary judgment for defendant-plan administrator and a denial of discovery regarding the termination of benefits is affirmed as: 1) there was no abuse of discretion as sufficient evidence showed plaintiff was able to work; and 2) there was no abuse of discretion in a refusal to compel discovery.
