Clegg v. Arkansas Dep't of Corr., 06-3119
In a suit against an employer and individual coworkers alleging race and gender discrimination, retaliation, and violations of the Uniform Services Employment and Reemployment Rights Act (USERRA), summary judgment for defendants is affirmed over claims that: 1) the district court erred in granting certain defendants qualified immunity; and 2) there were disputed issues of material fact that made it improper to grant summary judgment on other claims because she had in fact sufficiently demonstrated that she was subjected to an adverse employment action.
