US v. Garlewicz, 07-1182

A conviction and sentence for conspiracy to distribute and possess with intent to distribute a mixture or substance containing a detectable amount of methamphetamine is affirmed where: 1) defendant initiated a meeting with an officer and knowingly, intelligently and voluntarily waived his Sixth Amendment right to counsel, and thus a motion to suppress statements made at that meeting was properly denied; 2) the district court did not err in finding that defendant's statements were voluntary; and 3) a decision not to depart at sentencing was unreviewable, and the sentence was not unreasonable.
