Gilbert v. Des Moines Area Cmty. College, 06-3021

In an action brought against a community college by a former provost raising claims of racial discrimination and retaliation in violation of Title VII, summary judgment for defendant is affirmed as: 1) defendant provided legitimate, non-discriminatory reasons for its decision not to hire plaintiff for the position of president; 2) plaintiff failed to show that the offered reasons were pretextual; and 3) while plaintiff's demotion after he filed the suit was an adverse employment action, defendant showed that the basis for the demotion was certain plagiarism committed by plaintiff in a job application and that the action was not taken in retaliation for the filing of the suit.
