Minnesota v. Ctrs. for Medicare and Medicaid Servs., 06-3263
Petition for review of the adverse final determination of the Secretary of Health and Human Services relating to Minnesota's application for an increase in the annual supplemental Medical Assistant payments made by the federal Medicaid program is denied where Medicaid Services' increased scrutiny of the state's plan amendment was neither a new substantive rule that required notice and comment rule-making, nor an arbitrary and capricious decision that ignored adequate assurances provided by the state.
