Brown v. Fred's, Inc., 06-2503

In a suit involving claims against an employer under Title VII and the Equal Pay Act, summary judgment for defendant on the Title VII claim is affirmed where plaintiff presented insufficient evidence to create a genuine issue of material fact concerning whether she should be considered an employee of her employer's parent company. Denial of defendant-employer's motion for judgment as a matter of law on the EPA claim and an award of liquidated damages are affirmed where a reasonable juror could have weighed the evidence and found that plaintiff failed to prove that pay differences were based on a factor other than sex, and the district court did not clearly err in declining to exercise its discretion to reduce or eliminate the liquidated damages.
