City of Clarkson v. Mineta, 06-3613
In a suit by a city alleging that the US Dep't of Transportation insufficiently considered the economic and environmental impact of the construction of a sound wall by failing to comply with the procedural requirements of the National Environmental Policy Act, summary judgment for defendant is reversed and remanded where the district court failed to properly consider whether plaintiffs had standing to bring the suit.
