United States Eighth Circuit
Equal Employment Opportunity Comm'n v. Convergys Customer Mgmt. Group, Inc., 06-2874
In an action alleging that defendant-employer failed to accommodate an employee's disability in violation of the Americans with Disabilities Act (ADA), a judgment and award in the employee's favor is affirmed over claims that: 1) the district court erred in denying defendant's motion for judgment as a matter of law, averring that it could not be held liable for failure to accommodate plaintiff because he did not request a specific, reasonable accommodation; 2) alternatively, plaintiff's proposed accommodations were unreasonable; and 3) the district court erred by permitting the jury to award plaintiff $100,000 in compensatory damages and by denying a motion for remittur.
