Weidner v. Fed. Express Corp., 06-2522
In an ERISA action alleging that Federal Express wrongfully denied plaintiff's claim for total disability benefits under its long term disability plan, summary judgment for Federal Express is affirmed where: 1) the district court properly reviewed the adverse decision under the abuse of discretion standard as plaintiff did not show either a procedural irregularity or a conflict of interest sufficiently connected to the decision; and 2) substantial evidence in the administrative record as a whole supported the decision.
