Winters v. Arkansas Dep't of Health & Human Servs., 06-2787

In a suit alleging claims pursuant to 42 U.S.C. section 1983, the Americans With Disabilities Act, and the Rehabilitation Act brought after plaintiff's father died while a pretrial detainee in the county jail on a state law charge of criminal trespass, a judgment for defendants is affirmed as the district court correctly concluded that: 1) decedent was not discriminated against on the basis of his disability; and 2) there was no deliberate indifference to decedent's serious medical needs, nor was there a policy or custom to deprive mentally ill citizens of treatment.
