United States Eighth Circuit

White v. Howmedica, Inc., 05-4093

In a product liability suit involving a prosthetic knee manufactured by defendant and used in plaintiff's knee replacement, summary judgment for defendant is affirmed where the district court did not err in: 1) excluding plaintiff's expert's testimony on the ground he had not been disclosed in a timely fashion as required by that court's progression order; or 2) finding plaintiffs could not establish that the prosthesis was defective without expert testimony.
