United States Eighth Circuit
Reis v. Walker, 06-2825
In a dispute brought by former employee against the corporation's president and chief executive officer involving claims based on allegations that during her employment defendant made unwanted sexual advances, dismissal of defendant's abuse-of-process counterclaim is affirmed where: 1) the counterclaim alleged that plaintiff had filed suit for the purpose of coercing a settlement; and 2) filing a suit with that motive does not give rise to an abuse of process cause of action under Iowa law.
