United States Eighth Circuit

US v. Hilliard, 06-3270

Conviction for drug and firearm charges is affirmed where: 1) there was no error in the denial of a motion to suppress as officers reasonably believed a person who consented to search of the residence where defendant was staying was a resident of the home and had authority to consent to the challenged search; 2) the evidence was sufficient to support the firearms conviction; and 3) as the district court applied the Sentencing Guidelines in an advisory manner, there was no Sixth Amendment error in the district court's drug quantity determination.
