Oglala Sioux Tribe v. C & W Enters., Inc., 06-3480
In a declaratory judgment action brought by an Indian tribe asking that defendant be enjoined from pursuing arbitration on a road contract and a lease, and a declaration that the AAA lacks jurisdiction over the lease and contract, dismissal of the action is affirmed where the district court did not err in dismissing the action for lack of subject matter jurisdiction.
