United States Eighth Circuit
US v. Marasco, 06-3152, 06-3238
Partial grant and denial of defendant's motion to suppress evidence in a prosecution for manufacturing methamphetamine is reversed in part and dismissed in part where: 1) the court lacked jurisdiction over defendant's cross-appeal concerning items found in a motel room as the right of interlocutory appeal from a district court's decision on a motion to suppress is the government's alone; and 2) the district court erred in finding that defendant's statements to police were the fruit of an illegal search as defendant failed to provide a causal nexus between an illegal search of her purse and the statements.
