United States Eighth Circuit

US v. Boesen, 06-3290

Grant of defendant's motion for acquittal on one count of conspiracy and 81 counts of health care fraud is reversed as, viewing the evidence most favorably to the government, a reasonable jury could have found that defendant knowingly and wilfully executed a scheme to defraud a health care program, acting in a conspiracy with his brother, a physician at a clinic.
