US v. Smith, 06-2436

A conviction and sentence for conspiracy to distribute methamphetamine is affirmed where: 1) the evidence was sufficient to support the conviction; 2) the imposition of a mandatory life sentence under 21 U.S.C. Sec. 841(b)(1)(A) did not violate defendant's constitutional rights; and 3) a witness's single, non-responsive statement concerning defendant's prior incarceration did not mandate a mistrial.
