OnePoint Solutions, LLC v. Borchert, 06-2481
In a diversity action brought by a company against former members of its Board of Governors raising state law claims arising from payments authorized to defendants after they were removed from their positions, dismissal of the suit, in part under Rule 12(b)(6), and the remainder for lack of subject matter jurisdiction, is reversed in part where a reasonable jury could award $66,000 in damages for the value of property stolen and punitive damages of at least $9,000 for purposes of the jurisdictional threshold.
