Cox v. Sugg, 06-2311
In suit seeking to hold university officials liable for sexual harassment plaintiff suffered from one of her professors while she was an undergraduate student, denial of officials' motion to dismiss 42 U.S.C. section 1983 damage claims on grounds of qualified immunity is reversed where plaintiff submitted insufficient evidence that defendants acted on behalf of the university with the requisite culpability to cause the professor's violation of plaintiff's right as a student to be free from sexual harassment.
