United States Eighth Circuit

US v. Ward, 06-3366

A conviction for conspiracy to distribute marijuana is affirmed over a claim of erroneous denial of a motion to suppress where: 1) for purposes of expanding a traffic stop, the circumstances including a patriotic magnet on a rental car, a newer lock on the U-Haul trailer, a DEA cap, inconsistent INS/Homeland Security credentials, air freshener, and defendant's nervousness, supported suspicions unrelated to the traffic offense; and 2) the 20-minute length of the detention was reasonable and did not involve delay unnecessary to the legitimate investigation of the trooper.
