Elnashar v. Speedway SuperAmerica, LLC, 05-3861

In an action alleging that defendant-employer discriminated against plaintiff on the basis of his Arabic race in the wake of the September 11, 2001, terror attacks, summary judgment and other rulings against plaintiff are affirmed where: 1) the evidence could not support any reasonable inference of discrimination, and thus, the employer was entitled to summary judgment; and 2) the district court did not abuse its discretion in refusing to grant a continuance or in refusing to compel disclosure of additional evidence from the FBI that plaintiff speculated would save his case.
