Higgins v. Gonzales, 06-2556

In a Title VII case brought by a former Assistant U.S. Attorney alleging racial discrimination and retaliation, summary judgment for employer is affirmed where: 1) she failed to establish an adverse employment action in the context of her Title VII race discrimination claim; and 2) as to a retaliation claim, plaintiff failed to show that supervisor's retaliatory actions were materially adverse such that a reasonable employee in her situation would have been dissuaded from complaining about discrimination.
