US v. Baker, 06-2580

A conviction for being a felon in possession of a firearm is affirmed where the district court: 1) did not err in denying defendant's motion for a new trial based on newly discovered evidence as the evidence was insufficient to warrant a new trial; and 2) did not abuse its discretion in declining to conduct a hearing on the motion.
