Mountain Pure, LLC v. Bank of Am., N.A., 06-2138
In a suit alleging breach of contract and promissory estoppel against Bank of America, summary judgment for the bank is affirmed in part, but reversed in part and remanded as to a claim of attorney's fees where, viewing the facts most favorably to plaintiffs, their attorney's fees were incurred as a result of the bank's delay in releasing certain stock and the bank had tacitly agreed to pay such special damages.
