Admin. Comm. of the Wal-Mart Stores, Inc. Assocs.' Health & Welfare Plan v. Gamboa, 06-2285

In an ERISA action brought by a family injured in a drunk driving accident, summary judgment for defendants, refusing to enforce a reimbursement provision in Wal-Mart's health benefits plan, is reversed and remanded where a plan administrator's interpretation deeming a "Wal-Mart Associate Benefits Book" to be a plan document was consistent with a "Plan Wrap Document" and ERISA.
