Droste v. Julien, 06-2385
In a dispute between homeowners and an architect over allegedly faulty building plans and other services he provided regarding the construction of a home, dismissal of negligence and negligent misrepresentation claims and various other rulings are affirmed where: 1) review of the dismissed claims was precluded due to an inadequate record on appeal; 2) a challenge to a denial of plaintiffs' motion in limine was moot; 3) although the district court abused its discretion in making a disqualification motion effective immediately, the error was harmless; and 4) there was no abuse of discretion in an award of costs.
