United States Eighth Circuit

US v. Bell, 06-2802

A conviction for drug- and firearm-related charges is affirmed where: 1) for purposes of a suppression motion, the district court did not clearly err in finding defendant's post-Miranda statement to police to be voluntary; and 2) sufficient evidence supported the convictions. However, the sentence is remanded for resentencing pursuant to a claim that the district court failed to group two of his three offenses in determining his advisory Guidelines range.
