Baptist Health v. Smith, 06-1601

Summary judgment for a doctor on his third party complaint for indemnity against another doctor for the repayment of a loan debt is reversed in part where the district court erred by interpreting a particular single-sentence statement in a letter as a clear expression of an intent to indemnify the doctor, sufficient to constitute an enforceable indemnity agreement under Arkansas law.
