Dunmire v. Morgan Stanley DW, Inc., 06-1947
Summary judgment for Morgan Stanley on state law claims based on its alleged violation of the Gramm-Leach-Bliley Act (GLBA) is affirmed where such claims failed as there was no violation of the GLBA because: 1) plaintiff's financial information lost its nonpublic character when he filed a reparations complaint disclosing his financial information to a third party; and 2) delivery of a demand letter to plaintiff's wife, currently in divorce proceedings, was an appropriate and acceptable method of settling or collecting a debt defendant believed plaintiff owed, and was a valid exception under the GLBA.
