Kennedy Bldg. Assocs. v. CBS Corp., 06-2371
In an appeal brought by CBS Corporation, the entity currently responsible for the contaminated Kennedy Building property in Minneapolis, an injunction enforcing the Minnesota Environmental Rights Act (MERA) against it is remanded for modification making the injunction's commands more specific. The court rejects arguments that the evidence showed there was no need for MERA relief, and that the district court had no power to require CBS to post a performance bond.
