United States Eighth Circuit

Int'l Bhd. of Elec. Workers, Local Union No. 124 v. Smart Cabling Solutions, Inc., 06-1881

Summary judgment for a union in a dispute involving the renewal of a collective bargaining agreement is affirmed where the district court did not err in rejecting the company's argument that by withdrawing from the entire collective bargaining agreement it had withdrawn from its binding arbitration clause, and that claims regarding the arbitrator's jurisdiction were procedural should have been submitted to the arbitrator.
