Minnesota Towers v. City of Duluth, 06-1118
In the context of Minn. Stats. Sec. 15.99, when a city council denies a zoning request previously approved by the city's planning commission, the requirement that the city provide written notice of the denial within 60 days does not apply, and the district court erred in finding the city had violated the statute and in ordering that an application be deemed approved.
