United States Eighth Circuit

US v. Ruff, 06-1616

A conviction and sentence for conspiring to distribute cocaine and marijuana is affirmed where the district court did not err in denying defendant's motion for recusal based on a law clerk's involvement in defendant's prosecution when she was employed in the U.S. Attorney's office, and did not err in denying defendant's request to offset a restitution amount with proceeds from confiscated items.
