United States Eighth Circuit

Dismissal of an inmate's 42 U.S.C. section 1983 action is reversed where the district court erred in dismissing the instant lawsuit under 28 U.S.C. section 1915(g) because earlier dismissals of complaints could not be counted as "strikes" for purposes of the section as plaintiff had not yet exhausted or waived his appeals in those cases.
