United States Eighth Circuit

US v. Zacher, 06-1652

In a prosecution for conspiracy to distribute methamphetamine and weapons-related charges, denial of a motion to suppress evidence police obtained by searching various FedEx packages and defendant's home is affirmed where: 1) a dog's first alert created reasonable suspicion, which permitted the police to seize a package for investigation; and 2) defendant failed to present evidence of a deliberate or prejudicial rule violation by the officers for purposes of suppression.
