Martin v. E-Z Mart Stores, Inc., 05-4175
Summary judgment for defendants in a product liability case arising from an allegedly defective cigarette lighter is affirmed where: 1) the district court correctly held that even if plaintiff were able to identify the particular lighter that was used, their proof would fail on the issue of product defect; and 2) it was not possible to infer from the circumstances that the cause of the accident at issue was a defective lighter.
