US v. Martinez, 05-4275

A conviction and sentence for bank robbery is affirmed where: 1) a cuffing did not convert a Terry stop into an arrest, and even if it did, officers had probable cause to effectuate the arrest, based on a wad of cash discovered during the Terry frisk; 2) a failure to suppress statements obtained in violation of Miranda was harmless error; 3) admission of the results of a show-up identification, and an identification of defendant by a teller did not violate his procedural due process rights.
