US v. Shepard, 04-3669, 04-3693, 05-1024, 05-1827

Defendants' convictions for conspiracy to distribute and possession with intent to distribute cocaine base are affirmed over claims of error regarding: 1) the bill of particulars; 2) a violation of Federal Rule of Criminal Procedure 5(a); 3) speedy trial issues; 4) admission and exclusion of evidence; 5) sufficiency of the evidence; 6) jury instructions; 6) a Brady claim; and 7) denial of a motion for a new trial. Two of the defendants' sentences are vacated and remanded for resentencing.
