In a civil rights case arising from plaintiff's injuries during an arrest, denial of a deputy sheriff's motion for summary judgment based on qualified immunity is reversed where, given the facts as alleged by plaintiff, no constitutional violation occurred and, alternatively, a reasonable officer would not believe the force used to arrest plaintiff to be excessive.
