Misischia v. St. John's Mercy Health Sys., 05-3403

Dismissal of a former employee's Racketeer Influenced and Corrupt Organizations Act (RICO) and state conspiracy claims with prejudice is affirmed where the district court properly found them barred by the doctrine of res judicata, and there was no error or abuse of discretion in denying leave to amend and a motion to disqualify. Defendants' motions for sanctions on appeal are denied as the issues raised were subject to reasonable dispute.
