Carter v. Kansas City S. Ry. Co., 05-2220/2429

A judgment setting aside punitive damages awarded to plaintiff following a jury trial in a Title VII racial discrimination case against his employer is affirmed where the jury abused its discretion by awarding punitive damages in the matter. On cross-appeal from the award, the court finds that plaintiff's claims were not barred by his previous complaint against his employer, and there was no error in the submission of the racial discrimination claim to the jury.
