United States Eighth Circuit

US v. Cook, 05-3731

On interlocutory appeal, a grant of a motion in limine to exclude certain evidence in a prosecution for drug- and firearms-related charges is affirmed where the district court did not abuse its discretion in granting the motion and excluding evidence of defendant's four prior drug convictions as too remote under Rule 404(b) of the Federal Rules of Evidence and unfairly prejudicial under Rule 403.
