United States Eighth Circuit
US v. Vertac Chem. Corp., 05-3147, 05-3153
District court's assignment and apportionment of liability for certain environmental cleanup costs pursuant to the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) is affirmed over claims that the district court erred in apportioning liability, that an earlier holding finding a company liable should be overturned, and that the district court's imposition of retroactive liability was unconstitutional.
