United States Eighth Circuit
Lewis v. Norris, 05-3288
In a capital murder case, dismissal of a habeas petition is affirmed on the ground that none of petitioner's state court post-conviction proceedings were "properly filed" under 28 U.S.C. section 2244(d)(2), and therefore, the federal statute of limitations was not tolled.
