United States Eighth Circuit

A conviction and sentence for being a felon in possession of a firearm and possessing an illegal firearm is affirmed over a challenge to the constitutionality of the statute making it a crime to possess an illegal firearm, 26 U.S.C. section 5861, the propriety of applying the statute to defendant, and the validity of his sentence.
