Smutka v. City of Hutchinson, 05-3167

Summary judgment for defendants in a suit alleging that they violated plaintiff's procedural due process rights when a municipality's utilities commission terminated his employment is affirmed where the district court correctly determined that plaintiff's pretermination proceedings were constitutionally sufficient, and, given plaintiff's access to extensive post-termination proceedings, it was not possible to say he was denied his procedural due process rights.
